Person and background

Meet Ruth

Ruth Morgan is 61. She has alcohol-related brain injury, type 2 diabetes and peripheral neuropathy. Before a prolonged hospital admission 18 months ago, she lived alone in a housing-association flat. She now lives in Willowbank, a 12-bed residential care home.

Ruth was previously a school administrator. She is sociable, values privacy and has always been described by her family as independent and stubborn. She enjoys live music, going to cafés and visiting the local market.

Her cognition varies. Staff report that mornings are usually clearer than late afternoons. Ruth can hold detailed conversations about some topics but may forget information after a short delay, especially when tired or anxious.

Capacity evidence

Conversation A — 2:15 pm

Ruth says, “I know they give me tablets and meals. I can go out when I want.” When told staff currently accompany her outside, she replies, “Only because they fuss. I can tell them no.” Ten minutes later she says nobody has spoken to her about going out.

Conversation B — 9:30 am

Using a one-page visual summary, Ruth accurately explains that the front door is coded, staff hold her medicines, and she is currently accompanied outside. She says these arrangements make her feel “watched”. She can describe that returning home might involve support visits, risks around medication and falls, and the possibility of a trial period.

Observed decision-making

Ruth compares two options for community access, asks whether accompaniment could reduce over time, and says she would accept staff holding medication “for now” but wants the door arrangements reviewed.

Son, Daniel: “Mum nearly died at home. If they let her walk out and something happens, that's on them. She needs to stay where she is.”

Key worker: Ruth is generally settled and has not tried to force the door. She asks most weeks when she can go out alone.

GP: Ruth's cognition is likely to fluctuate. There is no reason to assume that all decisions are beyond her.

Social worker: Current notes repeatedly use the phrase “Ruth is happy at Willowbank” but contain little analysis of her objections to restrictions.

Which statement best reflects defensible reasoning at this point? Ruth's general contentment means there is no deprivation of liberty. Daniel's risk concerns determine what is in Ruth's best interests. Ruth's contentment, specific wishes, objection or compliance, ability to give valid consent, the restrictions themselves and the wider context are all relevant to the multifactorial Article 5 analysis; none is determinative on its own. Because Ruth is not forcing the door, she has consented to the arrangements.

Post-AGNI: analyse Ruth's concrete situation as a whole

The main door requires a keypad code that Ruth does not know.
If Ruth asks to leave alone, staff redirect her or offer accompanied access.
Staff check on Ruth every two hours overnight.
Medication is stored and administered by staff.
Ruth has a mobile phone and receives visitors without supervision.
Staff would prevent Ruth leaving alone if she attempted to do so.
Community access currently occurs three times a week with staff support.

Post-AGNI practice point: the Cheshire West acid test is no longer sufficient by itself. Continuous supervision/control and freedom to leave can still be relevant, but the Article 5 question requires a practical, multifactorial assessment of Ruth's concrete situation. No single factor is determinative.

Ruth's position

Ruth says she accepts help with medication and would consider a trial of supported return home. She does not accept that she should always be accompanied outside.

Summative judgement

Apply the MCA and Article 5 analysis

On the evidence currently available, which is the most defensible capacity position? Ruth clearly lacks capacity because she forgets information and has a brain injury. Ruth clearly has capacity because she can state her preferences. The evidence is insufficient for a defensible conclusion until the decision is assessed with appropriate support, timing and relevant information.

Which statement best reflects the post-AGNI deprivation-of-liberty analysis? There is no deprivation of liberty because Ruth is generally settled and not actively trying to leave. Because Ruth is subject to significant supervision/control and would be prevented from leaving alone, the Cheshire West acid test determines that she is deprived of liberty. A conclusion requires a multifactorial assessment of Ruth's concrete situation as a whole. The supervision/control and freedom-to-leave features are relevant but not sufficient by themselves; the analysis must also consider the type, duration, effects and implementation of the measures, setting and relative normality, externally imposed restrictions, Ruth's wishes/feelings and objection or compliance, purpose/context, and whether she can give valid consent for Article 5 purposes. It becomes a deprivation of liberty only if Ruth or her family formally objects.

Which professional rationale is defensible?

Select the strongest record. A. Ruth lacks capacity due to alcohol-related brain injury. She is happy at Willowbank and her son agrees she should remain. Current restrictions are in her best interests because they keep her safe. B. Ruth has mixed evidence relevant to capacity for consenting to her current care arrangements. Afternoon discussions showed difficulty retaining information, but a morning discussion using visual information showed improved understanding and ability to compare options. Before reaching a capacity conclusion, the assessment should be repeated with optimal support and clear information about the actual restrictions and realistic alternatives. Separately, the Article 5 analysis must be multifactorial and grounded in Ruth's concrete situation. The coded exit, staff response if she tries to leave, regular checks and controlled community access are relevant, but they are not a stand-alone acid test. The record should also address the type, duration, effects and implementation of the measures, the relative normality of the setting, whether restrictions are externally imposed, Ruth's wishes and feelings and any objection or compliance, the purpose/context of the measures, and whether she can give valid consent for Article 5 purposes. Ruth's wish for greater freedom, her acceptance of some support, family risk concerns, less restrictive alternatives and review arrangements should be recorded distinctly rather than collapsed into a single 'safe/happy' conclusion. C. Ruth's placement is necessary because the risks of returning home are too high. She is not objecting to living at Willowbank, so the current care plan can continue while staff monitor her behaviour.
